Terms and Conditions

1. The following terms are used in the Terms and Conditions:

1.1. Right of Withdrawal – The Consumer’s right to unilaterally withdraw from the contract within a specified period (to refuse the order) without paying a penalty, interest or damages.

1.2. Prices – the prices of the respective goods indicated in the Online Store, for which the Seller offers them for purchase.

1.3. Online Store – the website maintained by the Seller, which is located on the Internet at www.zustina.co.in and through which it is possible to purchase the goods offered by the Seller.

1.4. Order Payment Day – the day when the Seller has received payment in full for the goods specified in the respective order in its settlement account.

1.5. Consumer – a natural person who expresses a wish to purchase, acquires or could purchase or use a good or service for a purpose that is not related to its economic or professional activity.

1.6. Seller – Limited Liability Company Zustina Textures Private Limited.

1.7. Buyer – a person who orders goods in the Online Store. The Buyer can be both a Consumer and a non-Consumer.

1.8. Shopping Cart – the goods selected by the Buyer in the Online Store;

1.9. Parties – the Buyer and the Seller.

2. Terms and Conditions Scope

2.1. The Terms and Conditions shall determine the relationship between the Buyer and the Seller.

2.2. In addition to these Terms and Conditions, the legal relations of the Parties shall be determined by the Civil Law, the Commercial Law, the Consumer Rights Protection Law and other laws and regulations of India.

2.3. The provisions of the Consumer Rights Protection Law and other laws and regulations regulating consumer rights shall not be applicable to the legal relationship between the Seller and the Buyer who is not a Consumer.

2.4. The order confirmation, which indicates the specific goods and their Price, shall be considered an integral part of the contract concluded between the Parties.

2.5. The Seller shall be entitled to change and supplement these Terms and Conditions. The changes and amendments to these Terms and Conditions shall come into force from the time of their publication on the website www.zustina.co.in, and they shall apply to orders for goods made after the publication of the changes and amendments.

3. Goods Characteristics and Prices

3.1. Goods description, specification and Prices are indicated in the Online Store in the selection window of each respective goods. If necessary, additional information about the goods can be obtained by contacting the Sellers Customer Service consultants by phone +91 8009070029 or by e-mail: support@zustina.co.in .

3.2. The Prices of Goods shall be valid in case of timely payment, i.e. when making the payment in accordance with Clause 5.1 of these Terms and Conditions and in accordance with the procedures specified in Clause 6.3.

3.3. Prices shall be inclusive of all taxes. The Prices shall not include delivery fee.

3.4. The goods range and Prices shall be subject to change without notice. The changes and amendments shall take effect from the time of their publication on the website www.zustina.co.in, and they shall apply to orders for goods placed after the publication of the changes and amendments.

4. Shopping Cart and Order Processing

4.1. The Shopping Cart is created by the Buyer selecting the relevant product and using the Add to Cart menu.

4.2. After placing all the selected items in the Shopping Cart, use the Cart option in the upper right corner of the page.

4.3. The Shopping Cart shows all selected items. The quantity of goods in the Shopping Cart can be changed using the menus and To continue placing an order, use the Place Order menu.

4.4. In the Delivery Info section, it is possible to select the delivery method, indicate the delivery address, check and specify the previously provided information, as well as specify additional information. The delivery fee and delivery time shall depend on the chosen type of delivery. To continue placing an order, use the Payment menu.

4.5. In the Payment Method section you can select a payment method.

4.6. The order shall be deemed to have been placed and shall become binding on the Parties at the time when the Seller has received the order made by the Buyer and sent the order confirmation to the Buyers e-mail address (or otherwise). The goods shall be handed over to the Buyer only after full payment for the order. The Buyer shall not be entitled to receive the goods before full payment.

5. Payment Procedure

5.1. Payment for the order shall be possible in one of the following ways:

5.1.1. Via Internet banking, using the Internet banking services specified in the Payment Method section;

5.1.2. With a payment card when paying online.

6. Delivery Procedure, Delivery Fee

6.1. There is a charge for the delivery of the goods. It is not included in the Prices of Goods. Information about the delivery of goods, including the delivery fee, is indicated in the Delivery section of the Online Store. Delivery is possible in all parts of the India.

6.2. The type of delivery can be selected when ordering goods in the Delivery Info section.

6.3. The goods shall be delivered only if the order is fully paid and the Seller has received full payment for the goods specified in the respective order in its settlement account.

6.4. The goods shall be delivered to the address specified in the Buyers order. The Parties shall agree on the time of delivery of the goods by telephone, by calling the Seller or the supplier of goods (courier) to the telephone number specified in the order. The Buyer may contact the Seller regarding the delivery of goods by calling the Sellers telephone number (+91 8009070029) indicated in the Online Store.

6.5. After handing over the goods to the courier, the latter may contact the Buyer to clarify the delivery information.

6.6. The maximum delivery time for the goods available in the Sellers warehouse shall be 20 (twenty) business days after the day of payment for the Order.

6.7. The term of delivery of the goods for the goods that are not available in the Sellers warehouse shall be agreed upon separately by the Parties.

6.8. If the Seller is unable to fulfil the order because the ordered goods are not available, the Seller may deliver the Buyer an equivalent product at an equivalent price. If the Seller does not deliver the equivalent product to the Buyer for the equivalent price, it shall inform the Buyer thereof and refund the Buyer all the payment made no later than within 30 (thirty) calendar days from the day when the Seller has received the Buyers order.

6.9. In order to facilitate the fastest possible delivery of goods, complete and accurate information about the place of delivery (door code, floor, exact entrance of the building, if there are several, etc.) should be provided. The Seller shall not be responsible for the delay of the delivery term, if it is due to incomplete or inaccurate information provided by the Buyer.

6.10. The goods shall be delivered together with the Bill of Lading – Invoice.

6.11. Before receiving the goods, the Buyer should present an identity document (identity card or passport) or a drivers license.

6.12. Before accepting the goods and signing the invoice, the Buyer should check the packaging of the goods. If damage to the packaging or the goods is established, it should be indicated in the Bill of Lading – Invoice and the Seller should be notified there of to the e-mail support@zustina.co.in or by phone +91 8009070029.

7. Information on the Right of Withdrawal and Return of the Goods to the Seller

7.1. The Consumer shall not be entitled to exercise the Right of Withdrawal once order is confirmed or payment is received by seller.

7.2 No return or replace of material is allowed, if customer face any issue, buyer should call on 8009070029 and mail support@zustina.co.in .

8. Other Terms and ConditionsM

8.1. A distance contract concluded between the Buyer and the Seller shall enter into force when the Seller has received the order made by the Buyer and sent the order confirmation to the Buyers e-mail (or otherwise), and it shall be valid until its execution (payment and delivery), or in the case referred to in Clause 5.1 of these Terms and Regulations.

8.2. The Parties shall be liable for damages caused to the other Party.

8.3. Information on the processing and protection of the data provided by the Buyer is indicated in the Privacy Policy section of the Online Store.

9. Important Notice for Buyers

9.1. The range and prices of the goods are subject to change without notice. Manufacturers of goods may change the specifications of goods without prior notice to the Seller. The goods description uses the information and images provided by the manufacturer.

9.2. The Seller kindly asks the Buyer to report any noticeable inaccuracies in the product description or image by contacting the Sellers Customer Service consultants by phone +91 8009070029 or by e-mail support@zustina.co.in .

9.3. All images and descriptions in the Online Store are located in order to provide as accurate information about the goods as possible. The images and description of the goods in question may differ slightly from the goods offered. If necessary, to clarify the goods specification and information describing it, before purchasing the goods, please contact the Sellers Customer Service consultants by phone +91 8009070029 or by e-mail support@zustina.co.in .

10. Complaints Handling and Dispute Resolution

10.1. Please submit a complaint about the availability or quality of the goods electronically by sending an e-mail to support@zustina.co.in  or in writing. The complaint will be considered within 7 business days from the date of receipt of the complaint, with sending a reply to the contact address indicated in the complaint. If the complaint has been found to be unfounded and you do not agree with recognising the complaint as unfounded, you shall be entitled to use the alternative dispute resolution options specified in laws and regulations by submitting a written application to the Seller of the goods for out-of-court dispute resolution, indicating:

  • Name, surname, contact information;
  • Date of submission of the application;
  • The substance of the dispute, the claims and their justification.
